View Full Version : Can a father get legal custody of daughters if wife abandoned the family 3 yrs ago?

I'm asking this as a concerned god-parent. My god-daughter will be 5 this year. She has 3 older sisters ages 7,9,& 10. 3 yrs ago her mother decided to leave her family for a married man, who is also a known drug dealer. Her husband who she left is a youth minister at a church. He is trying to get a divorce and full legal custody of his daughters. They have been living with him. He has been receiving help from his parents, sister, and church members. The girls live with him. Sometimes she might come to get them, but her boyfriend makes her bring them back. She just got an apartment, but used the girls names on the lease, but they don't live with her. She is also receiving food stamps and public assistance using their names. The father has tried on several occasions to get things switched to his name, but the Department of Human Services won't comply since she is the mother, and her name is on file with the girls. He wants to get full custody, but is afraid that the courts my give her custody because she is the mother. But, if he have letters stating that he presently has had custody of his daughters for 3 yrs, and his wife abandoned their family, is there any way he could get legal help with this?

No, such letters won't help him get a lawyer, but the authors of the letters may very well be helpful if they testify when he goes to court. Has he filed for divorce yet?
