View Full Version : Wife claims bancruptcy and lists joint debts

You have given some great info. I have not paid or acknowledged my debts of over $300,000 since June of 2006. However my wife (who is joint with me on some accounts) has recently claimed bankruptcy and listed these debts for the trustee to contact. I have not signed any of her papers.

Will her actions cause me any trouble ? Will the time limitations start over again for me on those debts that were joint?

Maybe. Creditors will no longer have the option to pursue her and, if they want to collect, will have to pursue you.

No. However, if it's a Chapter 13, collection against you is stayed between the time she files bankruptcy and the time she gets a discharge. It's possible that creditors could argue that somehow stops the Statute of Limitations clock from running. I don't think they would be successful, especially if the SOL doesn't run out during the period of the automatic stay.
