My son is on Probation for 6 years under 3 feloney charges of burglary, unoccupied structures, he just got out this week, we live in Florida and one of the conditions is no drug usage, he was with a friend last night that was smoking Pot he swears he did not engage, my question is this, if the police were to find this person smoking and came in to do an arrest and my son is there will he be in violation of his probation and sent back to jail? He is being stupid even risking this and I want him to see the answer from someone other than me since he thinks he is indestructable at 18 ys old.

You are right. He will be in trouble if he is in the presence of pot smoking. Whe he claims that he didn't smoke it himself, they won't really care.

One of his conditions is to obey ALL laws. Being in the presence of a pot smoker isn't doing that.
