View Full Version : Could I get all rights to my son?

My child's father hasn't seen him but once since he was born and he is now 2 months old and I have asked his father numerous times when he was going to come and see his son and he always says when he get to it. I'm wanting to get full custody of my son and his fathers right completely taken away could I use abandonment to do so if he does not see him before he is a 6 months or a year old? Oh and he does not pay child support.

Please read the posts in bold type under Family Law or under your question, and then Answer back if you have further questions. (And say if you have been to court yet and what the courts have ordered so far.)

Did you go to court to order child support? If not, then why would you expect him to pay support?

As Joy said there are a few sticky notes at the top of this forum (click on the Family Law link above) which contain the answers to your questions. Briefly, no you will not get his rights terminated and it is not abandonment.

You may be able to get full legal and physical custody if he does not fight it in court.
