My boyfriend has been in my sons life since day one all through my pregnancy and my son calls him dad and he loves him more than anything else. We recently decided to try adoption but we are not married and don't plan on it any time soon. Is it legal for him to adopt or do we have to be married? Thanks everyone

ANY question on law needs to include your general locale as laws vary by area.

Most areas do require that a couple be married for a step parent adoption.

Again, I agree with Scott Gem... a step-parent adoption requires a step-parent. What you are asking is that a court sever ties to a biological parent in favor of a person who has no legal relationship to the mother and no biological relationship to the child. That is probably not going to happen.

Why would the courts award a lasting legal binding for your child to this guy when YOU aren't willing to commit to a lasting legal binding to him?
