What motion do I file if Respondent and Attorney is a no show in a Florida court for trial? Trial was set for 3-3-2011. The Judicial Assistant made a call to her attorney on Monday to confirm the date and time. The court reporter said her office also called to confirm time of trial. Trial was set for 9am today but at 9:30 the Judicial assistant said her attorney called and that her and the client thought court was Friday. WHAT? I'm flying in from Ohio to have a trial for determination of paternity.

The judge probably can sanction the attorney for making this mistake.

You could move to default the opposing side, but it probably wouldn't be granted.

You could also move for an award of your extra costs caused by this oversight.
