I live in Texas and he lives in Missouri and he doesn't visit his soon to be 4 year old nor does he pay child support or ask about him for that matter. My husband wants to adopt my son but I know that isn't possible until me ex either forfeits his rights or they are taken away and I know he isn't willing to sign them away even though he is no way a part of my son's life. My ex was recently released from jail for possession of narcotics do you think that will help my case? I really just have no idea where to start and I want to get this done as quick as possible.

File in court for child support.

Often, when they find out they can get out of child support by relinquishing rights, they're happy to do so. But you have to have the child support order in place before they actually feel the effect of it.

If that doesn't work, and he refuses to relinquish voluntarily, you have to PROVE he is a danger to the child. If you cannot prove it and cannot get him to relinquish voluntarily, you CAN NOT FORCE him to relinquish.

The ONLY way to get an involuntary TPR is to prove the parent a danger to the child.
