View Full Version : How to file state tax return for H-1B taxes withheld in 3 different states in 2010

Hi,
I was on H-1B (since 2008 Oct.) for whole year of 2010 and changed my work in Sep. 2010.
For the first 9 months of 2010, my former employer withheld VA state income tax from my wages (VA is where I worked and lived before Sep. 2010); after I started my new job, my current company, based in MA, withheld BOTH MA AND MO state income taxes ( MA is where my company's hq is located MO is where I live). I looked up the VA state tax return file instruction but couldn't figure out the best way for me to handle the state tax return for 2010. I'd be most appreciative if you can help me out!

You need to file part-year returns for Virginia and Montana, paying taxes for income earned in each respective state.

You need to file a Massachusetts return as a NON-resident, claiming a total refund because Massachusetts has NO legal standing to collect taxes from you. You will need a letter from your employer that states you neither lived nor worked in Massachusetts for the last three months to send with the tax return PLUS a copy of the Montana return.
