My kids father wants to give up parental rights, he wants me to do it by the end of march 2011 or he will take me to court for full custody. He hasn't paid a dime in support . My kids are scared of him . I had a pfa against him for 3 years which just ended this past April. Doesn't he have to do the process of giving up the rights then once that's done then my new husband can adopt them . I have threaten letters from him and his new girlfriend and they say they will win custody even though I have provided for them for the past 4 years without his help , they keep moving , his ex wife has a pfa against him and he has nothing to do with that kid either .and how contradicting is it when he wants to give up rights but if not done by the end of march he is going to take me to court for full custody cause apparently I can't support them and I am un- fit in his eyes?

You cannot give up your rights - if you want to or don't want to. You can't do it. There's a heading on this forum that explains that.

If he wants to sign so that your children can be adopted by someone, he can do that but you cannot force the issue. Same thing applies to you.

What he thinks or doesn't think is immaterial. A Court will decide if you are a danger to the children. If you are not, you will keep custody.

I would keep a record of his threats and take them to Court with me - they could prove HE is unfit.
