My brother in law was summosed by the NY State Tax department of taxes that he never worked in 2007, he send a notirized letter to the NYST sayng that he lost his wallet in 2007 bur never call the police and never made any report. He supply the department whit his SS and other documents.

The NYST Tax Department replay to him said that he his has to pay the back tax and fines because they believe that the person in question id him.

My question his, How can he show to NYTAX department that he never wirked and that he never file for any tax year?

Ca he fight this matter in court? Or sending them different documents will help him?

I don't know what document he was sent. Was he asked to come in the NYS Tax Department for a hearing or review?

The EMPLOYER is the person who can resolve this. Has he contacted the employer? They often have photo ID or an address or something more than a SS card.

I've never seen a SS card used for ID purposes when employment is involved UNLESS this is a temp agency.

It usually takes about 3 years for tax due bills to show up, and if his identity was stolen in 2007, chances are it is going to appear as trouble in 08, 09, 10, and so on. Surely he reported SOMETHING lost, his Medicare cared or license or ATM card? He has a lot of work to do on this, because no one is going to believe him just because he got a notarized statement. See if a detective in his local police department is willing to help get him started, but don't expect them to do the work. He needs to make a list of what he remembers being in his wallet and what he has had replaced so far. But again, he has a tough row to hoe here. Hopefully you can help him.
