View Full Version : How do I get the biological father of my child to sign over rights?

Her biological father hasn't seen her in over a year. I have a protection order against him. He does not pay child support. He has threatened to take her from me and run away with her. He is in and out of jail constantly.

Can you prove these threats?

It is very hard to get a TPR and frankly, I don't think it would do you any good. I assume you are the sole custodial parent and he has no visitation rights. If so, then his taking the child would be kidnapping whether you had a TPR or not.

Is there a child support order ?
Is there a order for custody giving you full rights ?

What rights do you wish to take away that he currently has though the courts ?

After that, in some states, a history of criminal behavior and being in prison for long term can be a reason to take rights away.

Also if he is a proven danger to the child, either his rights can be taken away or for now he can lose any visits with the child that would not be supervised.
