View Full Version : How do I file since my visa status changed from J1 to H1b?

Hello. I was a J1 Hotelmanagement trainee from March 2009 until September 2010. For 2009 I got a full tax return (there had only been federal income tax withheld, no social security or medicare tax). In 2010 however my J1 visa ended in September and I returned on an H1b visa in December 2010. The question is, if I can still file as a non resident for 2010 and get a full federal tax return? Thank you so much for your help! I am Austrian, my income was $27,175, I worked in Las Vegas and I am single

For 2010 you will file nonresident tax return and Form 8843. If you have income during J1, you will claim treaty deduction. Your U.S. Tax Return: The U.S. Visas (http://taxipay.blogspot.com/2008/08/us-visas.html)
