View Full Version : Would Welfare Pay For a DNA test

I was just wondering if welfare would pay for a dna test because the father of my child which I know 100% that he is the father denies my daughter and won't pay me child support because of it.He won't pay for the DNA test either and I simply can not afford it.
Would the courts pay for it?

No. "Welfare" will not UNLESS the Judge orders it. The test has to be Court-ordered and supervised. You should have been told about your rights when you filed the paternity petition or support petition.
Go back to Court and tell them you need help with the cost.
If you have NOT filed and this is just something you and he are working out, you need to go to Court and file for support and whatever else you want.

Will my family lawyer be able to let me know about that.. I have a meeting with him tomorrow So I have to take him to court before they will pay for it ?
My laywer can't issue one or w.e

If you apply for certain forms of welfare, the welfare agency (or child support enforcement agency, if there is one in your jurisdiction) may seek to get the father to pay child support. If so, they may institute action against the person who is suspected to be the father. Before they do that they may foot the bill for a test and, if it is positive, will require him to pay them back.

And it is common to ask the father ( if he is proven to be the father) to pay for the test

He doesn't want to pay child support and he definatley doesn't want to pay for the DNA test.. and I'm in toronto

In NY the test is Court ordered. I've seen both parents ordered to pay; I've seen the Court pay. The argument has been why should the prospective father pay, particularly if the test proves he is NOT the father.
I still don't know what stage of the legal process this is in - what benefits have you applied for?

In my experience(WI), if the man is proven to be the father of the child, both parents are ordered to split the cost of the DNA test and child support is ordered. On the other hand if the man is NOT the father, the mother is ordered to pay the cost of the testing.
