Assalamu alikum,

Islam Question and Answer - They committed zina then got married, and they cannot remember if they repented before doing the marriage contract or not; do they have to do a new marriage contract? (http://www.islam-qa.com/en/ref/131467/fornication marriage)

Islam Question and Answer - They committed zina then they got married, and they are asking whether the marriage is valid (http://www.islam-qa.com/en/ref/96460/fornication marriage)

I cannot tell you how sad your question makes me.

First of all, tawbah for zinaa is 100 sashes. Think about it after you both have been slashed 100 times. Oh, you wicked please start repenting.

Do you think you will avoid the punishment of Allaah by marrying a zaaniah because of making zinaa yourself?

When a child is born of Haraam, what can you expect of them? How will they be protected from Shaitan, when Shaitan was having sex with you when you conceived the child? May Allaah forgive us.

This is my opinion and I'm not a scholar, so anything I have to stay has to be verified. 'Tawba' for zina is not 100 lashes. My understandings of punishments in Sharia are that they are meant to regulate the public sphere and are intended largely as a deterrent, not 'tawba'. What happens in your private sphere is between you and God. I would suspect that Tawba is also between you and God.
