View Full Version : Filling jointly if spouse doesn't have a SSN

Hello everyone. Quick question, I recently got married, on 1/7/2011. My wife works here in DC on a work visa, (for 2 years now)is a non resident and doesn't have a SSN so she doesn't get taxes withheld nor gets W2's. Do I file married filling separately or jointly? Thank you so much.

For 2010, you fle as SINGLE, because you were NOT married on 31 December 2010.

For 2011, you can file jointly with your wife in January 2012. If by then she does NOT have a SSN, you will submit Form W-7 with a notarized photocopy of her passport to get her an Individual Tax Identification Number (ITIN).
