I worked for about a month in 2010 as an IC, my total earnings with my other job I received a w2. I am waiting on a 1099 for apx 985.00 for earnings. I file SINGLE,HH, and have 2 dependents. Can I file my taxes without the 1099? My earnings from my w2's are $13,000 apx, and through turbo tax and just putting in that information I qualified for CTC,EIC, AND WILL BE RECEIVING A REFUND. State is very low only 125.00 which was all that was taken out so I'm getting everything back that I paid in for taxes.can I amend my 2010 taxes without penalties or fines?. can someone please help me get these answers... thank you

You can file without the 1099; just write under the misc income line that it hasn't arrived. (I'd give it a couple of days in the hopes that they mailed them out on 1/31.)

I once went through hell with a mismatched 1099. The IRS caught up with it 3 years later and claimed I had never paid taxes on it even though I had. Turns out they don't bother to check because it's easier for THEM, grrr. What did they do after I proved with great difficulty that I had paid? Sent me a form letter 'waiving my responsibility.' The IRS never admits they are wrong.
What I am saying is that it helps to have all forms attached when you file.

You have until April 15 so don't get refunds and then owe back. Too much work, too much grief. Either show the income now or wait for the 1099, but don't file an amended return.

If you KNOW how much you made under the Form 1099, just report it in your tax return and submit the return.
