Ok, So the situation goes as follows.

At a walmart, almost at the car when security stops my friend and myself. They directed all questions at my friend with regards to property being stolen. Sure enough he had product on him totaling about 80$. They directed us to the security office of walmart and read us both our rights. Told us both that we were being charged with possession, I mentioned to the security that I was not in possession of any goods not belonging to myself, do not understand the charge and I give him the right to search my person if he believes otherwise.

He said it doesn't matter you are with your friend, did the routine search and found nothing on me what so ever. I said to him politely, that is fine I will speak with the police officer when they arrive.

So police arrive, I was nothing but polite to them as they performed their information gathering process. They then informed us that we were being charged with Theft Under 5000$, I then inquired how that could be since I had not carried any merchandise out of the store, for that matter touched the merchandise even while in the store.

I was told that it did not matter as I was with my friend? The police proceeded to take down information even the car that we came in etc etc.. Released us on the spot however given us both a summons to appear in court for Theft Under C.C.

Is this just something that has to be explained to the prosecutor residing on the case? Doesn't seem right that I was charged with Theft Under. I could understand if the charge sounded more suited to what my involvement was. Even if it said accessory to commit theft under, which may or may not be an actual charge :P

Im hoping its just a matter of process where all suspects are named and this can be easily hashed out in court, I know my friend is not throwing me under the bus on this one and will state without issue that I was not involved in any way.
