Hi I'm 15 years old and my babyfather is 21 what will happen to him since I'm a minor and can he take my baby away

No, he can't take your baby away from you. He CAN file for custody and attempt to prove that you are unfit to raise the child.

The bigger problem is that he has committed statutory rape and could go to jail as a sex offender, carrying that record for a very long time.

What do your parents say? Have you filed for support?

- my parent didn't pay attention to age they where mad because the way he look but yes I filed for support

You filed for support, the Court KNOWS his age and your age... and the Court did nothing?

I'm amazed. I'm also amazed that your parents aren't concerned.

But, anyway, unless the father can prove you are a danger to the child he cannot get sole custody.

Review the thread. I don't see her confirming that the court knows about the statutory rape. She says she filed for support. It's unclear to me that she filed with the court or with a child support agency. And if she filed with the court, unless the matter has come up for a hearing it is unlikely that a judge has had a look at the case yet.

Let's get it straight here. Did you or anyone go to the police and report that an adult had sex with you when you were underage?

Has a paternity test been done to confirm he is the father?

Florida Statutes, Section 800.04:
A person who:

(a) Engages in sexual activity with a person 12 years of age or older but less than 16 years of age;...

Commits lewd or lascivious battery, a felony of the second degree, punishable as provided in s. 775.082, s. 775.083, or s. 775.084.

So this man is guilty of violating 800.04 and should be prosecuted for it. Someone, your doctor, the court, etc. should have gotten the police involved. If that hasn't happened, you should march down to police station tomorrow morning and report it.

He is a criminal and should be in jail.

He can not take the child away unless he can prove you unfit.

Are your parents helping with raising the child.
