What happens if I don't take my 2 year old child for visitation to cairns I'm single mother in melbourne and I have a court order and the father has been ordered to refund me the total for the child's ticket return and he has done that for the past year.. we went back to court and the same judge gave him a warning and he had a period to pay all tickets for the year and he has only paid not even half... can I refuse visitation as he is not support his child in any way?

Visitation and support are two different issues. Is there Court ordered support (other than the refund)?

Go back to Court about the tickets.

I'd argue that you can't afford to send the child if you are not reimbursed.

Thank you but i will also add that the court order is for shared parenting and visitation... the court order says that any member of my family are able to acompany my 2 year child... the last visit to cairns my parents went i email the father with all flight detail and cost he received it as he ask me to break down the cost...

My parents went to the drop off and pick up location and the father didn't turn nor call to say he wasn't able to make it... it happened twice the first two days he never turned up, I called him and txt and i had no luck... i had a boyfriend that was helping me but as his got a mortgage and small business it was too much so we end relationship...

On the single parenting from centrelink its very hard for me pay our rent shopping studies our ticket return to cairns accommadation food hire a car petrol... on my own without he helping its impossible...

I have sent the father so many email regarding the different stages that his daughter is going through but he never replies...

I have obey my end of the court order and he is breaking hiis and our circumstance has change... what is the best thing for me to do?

Thank you
Nadia

Take him back to court for contempt. If he is violating the court order then you have a big problem going on. You may also want to consider a modification of the visitation so if he doesn't hold up his end of the bargin or causes a cancelation your entitled to get your funds back.

I did the judge renforcing his part of the court order he had until the 17 of November to pay back the money but he did only 2 payments... also for christmas I took my daughter for visitation and the father didn't show up to pick her up he didn't call or email two weeks before we left melbourne I emailed the father with all flight details including cost and times to pick my 2 year old child... its hard as a single mother io went up there and the first 2 days was a waste time and money
Where do io go from here?
