View Full Version : I'm 50% disabled from the va can I lower child support?

I am 50% disabled by the military I have an obligation to pay child support and they are going off a previous job where I was making over 2500 a month now my only income is the 1000 I make from the va. Before I got the 50% I left my job to be with my wife in another state and got another job but I only made about 1500 a month and the court denied an appeal for lowering the child support because I left my job with out a good reason. But now that I'm disabled and its only 50% and I can't work will the court lower the child support or will I have to make 100% before I can try again? Please help I am so far behind in child support... I do not get SSD its in the process but it could take years.

You have to file in Court for a reduction in support and show grounds. Until reduced support is ordered you owe the current amount.

Is being 50% disabled by the military enough grounds or will they say sorry but if your not 100% you still have to fin d a job making what you made when the order was made?

You never know what a Court is going to say until the Court says it - the Court's interest is that your children be supported. I think this could go either way.
Have you consulted with an Attorney?
(This is a good question, by the way. Interesting.)

Yes. They said try to get ssd and then come back but it could take years before I will get that and my child support will only get more backed up as I wait. I'm also scared because that's my only source of income and if the court finds out I

Get it they will take it for backchild support and leave me with nothing to support the rest of my family. I am trying to get a higher disability rate from the va but that takes time too. As of right now the va is going of my military pay and the

Order is for $1300 a month and I only get $1010 a month. I don't know what to do... :( the court told me the last time that I need to find a job making the same or more than hat I did in the military.

First please stop using that comment feature, you can't get enough info in it. Please "answer" your own question.
You being or not being disabled has nothing to do with your ability to file. What the reason is you can file if you have a change in your income, if you went from making 2000 a month to making 1500 a month you can go back to court to have the support adjusted.
