Hi,

I worked on L1 Visa from Sept-2007 to Dec-2009, My W2 is generated for year 2007,2008 and 2009. I came back to my home country on 01/01/2010. Since I worked for almost 2.5 years, I received some other settlement amount other than salary (around $ 4500 ) which were credited to my account in January 2010. This amount was shown under adjustment section under ADP site.My company has already deducted Federal's and state tax for this amount(which is not reflecting in W2).
This settlement amount was not accounted into my W2 form thus I filed my return in 2010 without that amount.
My question is ,

1. would I get a new W2 form this year(2011) of that settlement amount.
2. Do I need to file return this year.
3. Can I get any tax benefit, refund in this case since this is counted as my 2010 earning and that too only $4500.

If you got the settlement in January 2010, and it exceeded $3,650 in taxable income, then, yes, you need to file a tax return, probably Form 1040NR.

The settlement got crdited on 12/30/2009 but did not refelect in w2 form. It is shown under adjustment section on Payroll/ADP site. The required taxes had also been deducted from my salary acount but not refelecting in w2.

Okay, then report it on your 2009 tax return. If it already filed, amend the return.
