View Full Version : How do I evict my roommate?

I'm the sole leaseholder. Have a one year lease with my landlord. My roommate moved in only a month ago and has violated rules within the lease (damaging his room, writing on the walls with sharpie, etc.). He didn't sign anything and we only had a verbal agreement that there wouldn't be structural or cosmetic damage to the apartment and leave it in the same condition that it was in when I moved here. Can I just tell him to leave or do I have to go through the eviction process? I'm seconds away from throwing all his stuff on the curb.

Also, I've been living here for a year and 7 months now. I pay rent weekly and have receipts with my name on it from every week that I've lived here. He's only been here a month and his name isn't on anything, hasn't even changed his address yet either.

Here is what you can and should do; start by asking him to leave. If he says no to this then tell him he must leave. If he says no to this give him a 30 day notice to vacate letter mailed to him certified return receipt. After 30 days if he is stll there then evict follow the eviction process for your area. Agreed, you can ask him anything, you can demand even, but you can't throw his things out or you will just be paying for new things when he sues you for illegal eviction.
If they will not just move out, you have no choice but to go though formal eviction process

I plan on asking him in to leave in the most civil way possible and would like nothing more than to have this end peacefully. I live in Massachusetts. It shouldn't be a problem since he is intimidated by me to begin with, not that I would threaten him with physical harm at all. I just want to make sure I handle it the right way. He is a jerk, in the most literal of the definition, and he does deserve an ***-kicking but I'm not going there. Thank you both for your info.
