View Full Version : I didn't sign the lease but I live with others can I move without trouble?

I moved into an apartment with my friend and her family back in September. The lease was for 2 apartments 2 bedrooms in each for 800 total in rent. It was only supposed to be me and 2 others in our apartment and now it has grown to 10 people with only 3 paying. I know I don't have the money to support the others yet I'm told to every payday. When I decided to move I was told by my friend's mom that she would keep all my things if I move. Can she legally do that and will I be responsible to pay anything to her since no bills are in my name and I didn't sign the lease?

If you did not sign the lease and are not named on the lease, then you you are THEIR tenant (not the tenant of the apartment owners). Without a lease, you are a periodic tenant. This means you can give notice (generally one rental period- ANY question on law needs to include your general locale as laws vary by area.) that you are terminating your tenancy.

If she tries to prevent you from moving your belongings you can sue her. If you are concerned about that. I would find a new place, arrange to have your things moved, then show up with the moving van and hand her a notice of termination with a check for the next 30 days or whatever the rental period is.
