My employer deducted payroll taxes for New York city whereas I worked in New Jersey. What is the remedy available to me? Will I get a refund of excess taxes paid to NY city?

Where do you LIVE?

NYC income taxes are assessed based on whether you LIVE in New York City, NOT on whether you work there.

Then your employer is in error. Provide him defnitive proof that you LIVE in New Jersey and he should STOP the NYC withholding and refund the withholdings done since 1 January 2011.

Withholding of NYC taxes for 2010 will need to be recovered by filing a NY state tax return.

And what about the NJ taxes that my employer omitted.

If you both LIVE and work in New Jersey, you have NO NY State tax liability.

Have your employer STOP withhold NYC and NY state taxes for 2011.

For 2010, you need to file a NY state income tax return to recover the money withheld for NY state taxes that you do not owe!
