View Full Version : Breaking a lease on an apt. When your house bid has been accepted.

Hello, I just signed a lease for an apt. and three weeks later we were told that they accepted an offer on a home that we put a bid on. We went to the rental office and asked if we could do month to month and pay the difference in monthly rent and management said no. Is there any law that protects us from being able to break the lease when your purchasing a home?

Short answer, no. You made a business deal with party A. Now party B comes along and has something else for you. The first deal was and is still a deal and party A has done nothing wrong. The laws actually protect party A from you. You can make all sorts of offeres but legally you must pay until a new tenant rents this apartment, in most states. Where do you live? Many states require the management to make an ernest effort to rerent but you may have to pay their advertising costs in addition to rent until its rented. Your best bet is to offer a few months rent to be released from the contract. That way the managements get their money in hopes they will find a new teant asap and keep the double rent. It's a crap shoot but worth trying
