The father of my son ask for DNA test before to pay me the child support 7 months moths a go,
My son is almost 7 years old and his father never take of him sice he was born,
We never get married
I'm a Mexican citizen but I live in Iceland with my husband and my baby girl one year ald
My son and I move to Iceland 2 years a go.
My son doesn't speak english, just spanish and Icelandic
He's father invited my son spend a month with him just for vacations...
The time expired en he dosen't want to return my son back home!
I never put any order of custudy I guess so... in the family court
The father of my son is in San Diego now
I need full for custody!
I thought I have it!
I need a lawyer but!
Where??
How?
Hat can I do?
I desperate!!

And thus the trouble, BY most states in the US, there is no requirement for the father to pay anything unless there is a court order, so here, you just failed to file for support, and nothing is due yet.


But what he will be claiming is that they are US residence and the hearing need to be done.

You can hire an attorney there to object and make a motion that that court does not have the right to hear the case, since you and your son are really residnece of your nation.

When you moved to Iceland was this with a military personel or an Icelandic citizen ?

I recive child support but, I don't have any order court for custody, I never thought I'll need it my son raise with me.

You need to understand exactly what the court rulings are. Generally, when a support order is issued custody IS established since it is the primary custodial parent who gets support.

So I suggest you look through the paperwork issued by the court and see what it says exactly. Maybe have an attorney look through them for you.

If the paperwork does establish that you are the primary custodial parent, then you have a copy of that paperwork, get copies of your son's school registration to show he has been living with you in Iceland and you get on a plane and get your son and bring him home. If the father refuses to hand him over you call the police, show them your paperwork and, hopefully, they will force the father to release him. If not you will need to get a court order to do so.

Does your paperwork from the court specifically state that you are the primary custodial parent? If so, then you can do as I suggested and go get your son.

I can prove that I'm the primary custodial parent in court!
Also without my permission hi's father enrolment my son in school!
The father of my child disappoint my confidence,
I want sole custudy of my son.
And he is blocking to have contact with my son also.
