View Full Version : Want to fight for custody of my little boy.

Hi there.

I am a South African engaged to an Australian man who does not have any children. I myself have been divorced for 2 years now with a little boy who has just recently turned 4. Our divorce agreement states that we have joint custody but I am the primary guardian so my little boy lives with me primarily.

I am concerned about my little boy! When he is at his fathers house (who lives with his best friend) he is surrounded by constant drug use, fowl language and is allowed to play violent video games with age restrictions of 12 +. It truly does affect his behaviour and he is starting to resent me because he can get away with murder at his fathers house. He also does not pay the maintenance he is supposed to. Has records of insurance fraud and just does not have a clue how to be a dad.

My question is: Are those alone strong enough to hold up a custody fight between us. And also if I want to move to Australia to be with my fiancé and my son, can he legally stop me from going with good enough reason?

If he has a visitation schedule, then he may be able to block your move since it will affect his schedule.

As to whether he is a bad influence on the child, you will need to have a independent party do an investigation. I would strongly suggest consulting a local attorney.
