View Full Version : I was assaulted but suspect may get away with it on "peace bond" (Ontario/Canada)

I charged a suspect after a physical assault that left me with a bruised mouth. Now I'm getting word from the suspect's friend, he may be getting away with it (no punishment) with "peace bond". How do I make sure the suspect doesn't get away unpunished? I'm expecting at least a criminal record.

There is little you can do. You filed the report. After that you are merely a witness. If he has no prior record, there are extenuating circumstances, he has a good Attorney, yes, it is possible that he can walk away from this.

You don't charge the person. You file the report. The Police take it from there.

Ask the Prosecutor - he/she is the person who knows what will happen next.

It is handled by the DA office, but you have no real control over what the DA decides, most cases are settled by plea bargains and first time people often get a first offender program.

YOu may discuss your concerns with the DA or ast DA doing your case, But they are free to do what ever sentence they want if the judge agrees
