Depends on whether the disability is from his work, or from Social Security, or from a disability policy on which your husband the premiums.

If the disability check is from Social Security, it is taxable if combined with other income. By itself as your ONLY source of income, it is NOT taxable.

If the disability is from his work, it effectively replaces his earned income and, because the premiums are paid by the employer, is FULLY taxable.

If the check is from a PRIVATE disability policy paid for by your husband, then the duisability payments are tax-free.

-Well first of all to start, I feel like dr.phil! And no you do not. That's basically like stealing! You don't want to claim your husbands disability check then claim it on your taxes. Because its not yours.

That is NOT necessarily true.

First, it is NOT clear whether the husband is deceased.

Second, there may be a Survivor's Benefit option which allows her to continue to get the disability checks after he dies.
