My husband and I have a 3 year old daughter. We are still married and there is NO custody agreement or divorce in progress, he is in the military and has orders to report to Fort Cardon Colorado from Fort Stewart Georgia on February 10, 2011. On Nov. 14, 2010 I was arrested and put in jail for a DUI and was just released on January 13, 2011. When I returned back to our house a neighbor told me that my husband left the state with our daughter on or around January 5, 2011 when he could have waited about another month to leave. He also got rid of all of my stuff. Is he legally allowed to leave the state with our daughter without a custody agreement in place and without even telling me? Does he have any legal obligation to give me any support because he closed our bank account and left me with no place to live, no money and none of my belongings including my military ID, birth certificate or social security card?

There is no separation agreement, no divorce agreement, no child custody agreement, and you were in jail. So yes, he can move. You are stll legally married, but it appears he was planning on leaving or was the DUI too much for him, since it is unheard of to spend two months in jail for a DUI in GA unless this is the 2nd or 3rd or unless no one would make your bail.

Sp have you contacted him, are their plans for you to follow him ? Perhaps he moved all of your stuff also, ( how do you know he got rid of it ?
