You cannot file "jointly" with "wife as head of household". Please clarify what you hope to accomplish.

MA0641 has it right; you will file jointly with your wife even if she has an ITIN.
I assume the children have either SSNs or ITINs. If so, and if they were present in the United States, you CAN claim the Child Tax Credit for them if they were 16 years of age or younger at the end of 2010.
Whether you qualify for the Earned Income Credit depends on your income level.

We are going to file jointly.
Just my question will he be intitle to get the earned income credit even though I have an itin. Will he get a lot less money because I don't have a social security number?

No, the ITIN makes no difference.

Thank you very much.
One more question can my husband claim my cousin who is 11years old.
He has been taking care of here and will become her legal guardian

Did he provide more than half of her total support and did she live with him for the entire year of 2010?
