I'm on a weekly rent payment plan verbally. I haven't been able to pay rent in the last three weeks because I'm a painter and during the holidays my work has slowed down. I also live in my boss's friends home. The verbal agreement was if the work slowed down that my boss would take care of the rent, and he hasn't done so. Now the landlord has came by today and his wife and they both gave me only 7 days to vacate their premises. What can I do? They both stated that if I'm not gone in 7 days that they will have the Sheriff here to put me out. Can they do this without any type of court eviction notice?

No, but being on a week to week basis, they can give you 7 days notice to vacate. If you don't leave then they can file for an eviction order. So that may give you another couple of weeks to move.

But there's no lease, no proof of the week to week rent agreement, it was made verbally. Do they still have to file with the court to evict me?

YES. The sheriff isn't going to put you out WITHOUT an eviction order. If THEY put you out, or change the locks, they're committing an ILLEGAL eviction and you can sue them for big bucks.

First please don't use the Comments feature for follow-up. You told us it was a verbal agreement. That doesn't matter. You can prove you lived there, correct? You have cancelled checks or rent receipts, correct? Even without that they can't just put you out. And a sheriff isn't going to act without a court order.

Yes, the only exception to the eviction was if you were living on a week to week basis in a motel, the rules there are different, but if this is an apartment or private home, they will have to file in court to evict you legally.
Now 1000's of people are evicted illegally also, so if you come home and all of your belongings are in the driveway, you also don't have money to sue them.
