View Full Version : How can I remove Non Biological Father from Birth certificate?

I did a DNA test when my child was first born proving that the man I was with was not the father he still insisted on signing the birth certificate. Now Im wanting him removed I found his real dad but He's not wanting anything to do with the child. How do I go about changing the Birth Certificate and removing the Guys name?? Do I have the option of leaving it blank?? With just my name on due to personal reasons!!

Depends on the State - in NY when the identity of the father is established that name is put on the birth certificate whether the mother wants it there or not.

Have you gone to Court for child support from the biological father?

Otherwise it depends on the State. If someone who knew he was not the father signed the birth certificate he has committed fraud, apparently with your help. You could have problems down the road because of this fraud.

If you go on public assistance the man on the birth certificate will be billed for whatever is paid to or for your child, perhaps all, perhaps a percentage.
