View Full Version : Credit Card Debt and Motion for Entry of Judgement... I need help!

I am being sued by a credit company for a debt. They filed and served me in September in Colorado, I filed a response to provide information to validate the debt in October prior to the date to appear. I included a letter to the plaintiff attorney to advise that the following week I was going to be moving my primary residence to Kansas for a new job. I received a mailed letter advising they have filed a motion to enter a judgement for my failure to appear at pre-trial. Apparently there was a pretrial scheduled for Dec that I was not aware of... either didn't get forwarded to me or wasn't sent.

I plan to file a response to prevent this without my input. What are my rights since I no longer reside in the state where the proceeding are occurring? I have had many issues with other companies and have worked very diligently to pay the debts. THis is the 5th of 7 debts that I was working on. I would very much like to come to amicable terms that would serve both parties. I tried the attorney's e-mail on their website and can never get the email to go through... I have called during the holiday season to discuss directly, but the phone only rings and there is no answering service. I can likely pay a lump sum negotiation on 4/1/11, so I just need to keep things going until that time. I have a house of cards with another settlement and several other accounts I am about to pay off... the acid in my stomach is eating me up... I have two residences and am trying to keep my new job... Please help with any support or info!
