View Full Version : Can a apartment leasee evict an occupant only?

I have a roommate that I no longer want due to finicial issues that she is having. I'm the only one listed as a leasee on the lease, my roommate is listed as occupant only. I'm hoping that I will be able to stay in the apartment and have her move out.

So far I haven't tried anything things drastic yet. I've so far been trying to contact my roommate but she seems to be avoiding me to discuss concerns that I'm having.

I'm looking for advice of what I can do to have her removed from the apartment? Would I be able to remove her from lease with only my permission? What can and cannot do with her possessions?

Not sure what the law is in your state, however, you should be able to formally evict her. Meaning, going to the court house and filing eviction papers on her just as your landlord would if he/she decided to evict you. They will give you guys a court date and she will have to appear in court and the two of you state your case. She will have to come up with the monies owed within a specified time frame (usually 10 days) or vacate the premises. Start with contacting your local civil court office they should be able to advise you on what you can and cannot do.
