I have a restraining active since 2006 [domestic violance].. I took my ex boyfriend [will call him the defendent] to court for a child support issue, and he keeps coming off the topic with the judge lying about me taking advantage that I have the restraining order using it against him and making his life impossible. He says that he has "petitions" that people signed because they are witnesses of me taking advantage of him... I don't even see this freaking guy at all, I don't talk to him or anything I stay as far away as possible. The 3rd party contact is his dad [because of the court] and he is the one that picks the kids & drops them at the police station when is the defendants weekend [every other weekend]. The defendant appears at the police station to get the kids once in a blue when his dad cannot do it and is always inside the Elizabeth NJ police station.

The defendant told the judge that he wants the restraining order taking off him.. can he do that.. or that up to me..

He can petition the judge... its his right. But that doesn't mean he will win. He likely won't. If YOU however want the order removed, you will likely get it granted as you are who requested it in the first place.

If you can document what you say its unlikely he will get the RO removed. He will have to show the court how its making life impossible for him.
