My sons father and I have never gone to court to determine custody. Well he just told me that he is sending my son in a week out of state to his grandmas for 6 weeks. I do not agree with that. Two weeks would have been OK. He already bought the ticket. Is there anyway I can legally stop him:confused:

Not let him go, if you have physcial custody, just say no and have the child somewhere else when the dad comes to pick him up. At this point you both have legal custody, but only one has the physcial custody.
But this also means most likely you also don't have a child support order in place either.
Take this as a wake up call to go to court and get custody in writing and to get your child support in place.

Since there is no visitation order, neither you nor he have a leg to stand on. You can't legally stop him and he can't legally compel you to permit him. You're immeshed in a battle of wills.

I believe there is a paper to the judge Asking for an ex-party emergency two day court date
Phone free consult and ask him questions like would you be able to stop him takeing your son out of state without permission and if so what form would need to be filled out you can get them for free or a couple bucks.This takes away appt's needing to be made saves the argument with the family law on them not being able to legally recommend wich forms to fill out. Knowledge is power I am finding.
