This is hilarious! Those of you that have been following my personal life story in reference to my divorce in the year 2000 may find this hysterical. As a reminder, in the divorce I received custody of our children and was awarded child support. As of the year 2010, I have received ZERO support payments and mom has always gotten away with it. Her arrearage is now in the 270,000-plus thousand range. Not to mention, we shared joint businesses, which she was allowed to maintain control of, as long as she provided me with 1/2 of all its income within 7-10 days of receipt. Again, never received a dime. Have I been to court on this issue? NUMEROUS TIMES! The judge always gives the same final ruling, "Mamm, you know it is your responsibility to assist in providing for your children." "Mammm, you know you are required, by law, to abide by the court order." Ex-wife follows up by saying, "Yes, your honor, I do." Done. Finished. Over. I've seen it happen over and over and over again. I was told she would never go to jail because she now has 3 other children from her new marriage which are all under 5...

Anyway, listen to this. Mom, who know lives in the Mid-West, was finally found by Child Support Services Department and I received 3 checks in the mail (one each month in the amount of $75.00. In my excitement that it appeared they had caught up to her and were finally going to do something about my case, I contacted them to see what could be done. Could she be found in contempt? Would they pursue criminal action? Guess what I was told, "Sir, as long as she is making consistent payments, there is nothing we can do. And, for 3 months she has consistently made a payment and we see she just made another in the amount of $80 - so, as of now, she is in good standing." LOL LOL LOL LOL... HAHAHAHAHAHAHAHAHAHA... WHAT THE HECKKKKKKK!?

I guess she successfully beat the system at your expense, Mr. Payne. Sorry to hear that and I hope you can, at some point in the future, receive retribution.

So... do you have a question?

I guess I really don't understand something - you state that she is running a business, which means she is required to file a tax return. If she is THAT far in arrears, her tax return would be intercepted and sent to child support. Yet you state you haven't received payment. Something's not adding up about your story.

Are you receiving financial assistance through the state? If so, your child support may be going to reimburse the state for the benefits you are receiving. This is something I just personally learned within the past week.

EDIT: I thought you said you received quote, "ZERO support payments" yet in August you stated that she made some payments

If you're going to complain, I'd appreciate if you'd keep the story straight. It's very hard to feel sympathetic for someone whose story keeps changing.

My story is straight. I've told everything. At this point, she has lived in 3 places - Los Angeles, Atlanta, and Illinois, so I think the case is bouncing everywhere.

The city which I live no longer handles Child Support cases through the District Attorney's office - that division has closed due to budget cuts - so they are all handled through another office. So, no to state assistance.

So how has she gotten away with not filing a tax return for the past decade? I guarantee you that if the amount were anywhere near to what you are claiming, she would either:
A) Have had her driver's license suspended
B) Had her tax refund intercepted
C) Be in jail
D) All the above

And no, your story is not straight. In August you stated you were receiving payments of $300/month. Today you stated that you have received absolutely nothing for child support, then immediately contradicted yourself and stated you had received three checks in the amount of $75 each. Your story is many things - straight is not one of them.

Congratulations, I found another hole in your story. You allege she has fallen behind an additional $18,000 in a mere four months, which would set child support at $4,500/month. This would mean that in the past 10 years, child support would have been a grand total of $540,000 - yet you allege she owes $270,000 and has paid you absolutely nothing. So what happened to the other half of the support?

This story is becoming more and more like fiction.

This! I guarantee you NOT because she is roaming the streets of Chicago WITH a driver's license - one for both California AND Illionois! Honestly, there was payment of $300 made -at this point, receiving $300 and (3) $75 payments is like ZERO

And, you are wrong. A, B, C and D have not applied to her. I believe, there is the possibility, she has put EVERYTHING in her husband's name - because you're right about taxes.

Good for her, I don't care if she puts everything she owns into the Easter Bunny's name. She HAS TO FILE A TAX RETURN, which means her social security number is on the return, which means it WILL BE INTERCEPTED.

Did you also see the posts, where I noted on 3 separate occasions, I went before the court and reduced support to zero! Dumb at the time, but I did.

And, what satisfaction would I get coming into a forum to create a web of lies? Believe me, I have far better to do than waste my time doing that. I am seeking genuine, real advice.

Also, I've never known her to receive so there isn't anything to "intercept" - During our marriage, we often owed anywhere from $20-50,000 in taxes at year's end! She has never paid quarterly taxes!

So, you told her that she owes nothing and are now mad that she pays nothing?

Genuine, real advice: file for contempt every single month she doesn't make a payment.

This - for the first five years after the divorce - I wanted to be left alone - she was starting custody cases left and right - attornies were costing like crazy - I agreed to place arrearage at zero so she would leave me alone! And, she did.

I need her assistance more than ever right now so I'm pursuing it. We just finished a custody case which left her with almost zero rights to the children - she is now reduced to two 1-week visits per year, no overnights, done in the city we reside.

Thanks for the "genuine" advice - and, I am going to do just that. Right now, I have a hearing set first to have the case moved from LA County as none of us reside there. Once moved, I will be aggressive in my county!
