View Full Version : Can I quit and get unemployment if I have been hippa violated by my boss?

I have been missing work due to a high risk pregnancy.My boss has told the employees and instructed them to tell customers that ask for me that I have been having a lot of medical problems,not showing up and will be fired soon.I am more than embarrassed and hurt by my boss' lack of respect of my personal privacy,but am being told to either resign or pretty much suck it up.I can not resign I have two children but I am humiliated and do not want to go back.Do I have the right to quit and pull unemployment until I can find another job that will respect its employees rights?

If you can prove your allegations, then you MIGHT win an unemployment appeal.

First, where do you get the idea you have had a HIPAA violation?

Generally, if you resign you don't qualify for unemployment. But, if what you say is true, you may be able to get unemployment.

If you quit you will be denied benefits on the first decission.

You will then have to appeal and have to prove everything you are saying and then you "MAY" win or you may not,
But in either case you will go several months with no benefits while the case is in appeal process

But from the company side, you either have to work and do all of your work as required , or take leave and not be at work, If you show up for work and can not do the job, they may be within their rights to fire you.

Is your employer your medical care provider? If not, there is no HIPAA violation.

HIPAA deals directly with the medical care providers and their patients.
