View Full Version : Got married to a yugoslavian and want out. What do I do?

I met this guy in Tennesse, we really hit it off so we done the whole fling thing and went to a little chapel and got married.. in just the past two months we barley talk and I moved to Florida with my parents.. How do I get out of this marriage?? Please help!!

May I assume your "feelings" got ahead of "wisdom". Marriage isn't anything entered lightly, but with someone you've known over a long period. The first 12 months is all "flighty gooey love" and there is no substance, no foundation. The REAL person doesn't come out until later... never marry during the gooey times, that's all infatuation. Wait until you've had a few real good fights to see how each other responds. Love is not a feeling, it's a decision. When things get tough you decide to stay married.

I'm not judging you, I'm only speaking from experience. I made the same mistake only I married someone I didn't even like just so I wouldn't be alone. I ended up getting divorced by default because I couldn't even find him. Any lawyer will know what that means. You basically have to put an add the paper to let him know you want a divorce, and he has 6 weeks to respond. If he doesn't it's a done deal. This costs less, and there's much more to it than the quick overview I just gave you, but it does work. At least it did way back in 1988 when I did it.

Thank you, but how could I get out of it with me in Florida and him in Tennessee? Because I am not going back there, there's no way I am.

Did you fill out and sign a marriage license? Was it filed properly by the person who performed the ceremony?

Contact a divorce lawyer in your area and ask him/her what it will take to dissolve you marriage.

You file and sue for divorce. That is how you get out of it, you may be able to file where you live, but then you may have to return for at least court to the other state.

That will depend on too many factors to list here.

And the one poster made it sound way to easy and was only in the case the location of the person not known and you after legal and proper search could not find them.

But you will need ( or at least should have) an attorney, so that is your first stop

Depending on your circumstances, when you speak to a lawyer, inquire about a possible annulment versus divorce as another option.

Get some free legal advise and ask if it's OK to file from Florida. I can't imagine that you have to live in the state of marriage to file a divorce. You just may need to pay for the ad in the paper of the town you believe he lives in.

Welearn, the ad in the paper isn't applicable here. The OP knows where her husband lives, she just doesn't want to go back.

Please - this is not valid legal advice. Service by publication MUST be approved by a Court. It must be in a Court-ordered format, in Court-recognized newspapers. As far as costing less, I don't believe that's true. A simple default is far less expensive.

I don't know what State you are addressing but it's not a "done deal" if "he" doesn't respond to service by publication, not by a long shot. These are the divorces which can be set aside.
