View Full Version : Can a judement against my husbsnd be inforced on joint owned property

We are trying to sell our property and was told my husband had a judgement against him,which he has bee paying on for at least 4 years and was told we could not sell the property until the judgement was paid off.this judgement is only in my husband's name and it is ten years old.what reciurse do we have?we don't have the money to pay a lump sum.what can we do to resolve this?

Hello y:

If they have lien on your home, it means the judgment has to be paid of OUT OF THE PROCEEDS of the sale.. It does NOT mean the house can't be sold.

WHO told you this?? I'd seek another opinion - probably a lawyers.

If the people who you have a judgement from, have placed a lien on the home or notified that they plan to do a lien, then while you may sell theproperty, at closing the lien will have to be paid in full from the proceedes of the sell.

Will there be enough money at the sell to pay off the judgement
