I received a letter from Financial Debt Recovery Limited today attached with a DRAFT statement of claim. Letter states that they will hold this action for 48 HOURS before instructing their legal dept to continue. States I owe 3500. More than half of that is probably interest. I am currently a stay at home mom for now , I do intend to go back to work. How do I find out how old this debt is, There is a specific name/request for this information (debt, fees, etc... ) What can I do for now?

You must dispute their claim and ask for verification of the alleged debt within 30 days, or it will be consider valid.

1. Instructed them all contact must be done in writing.
2. Validiate the alleged debt by producing the original contract you sign.

I am in toronto, Ontario. Do I have enough time to send them a letter to request this info?? Is this 48 hour phrase just another scare tactic? The first paragraph on letter states "So there be no misunderstanding in this matter, take notice that we intend to issue a statment of claim through your court of justice,,,,,,,"

I'm not well versed on Canadian Law, sorry, but maybe Captain Forest can help.

But they do have to verify their claim and the produce the original contract, the original contract is the only way to verify that you did sign it.

In today's world with computer anyone can scan a document, cut and paste anything to another document. Demand to see th original contract.

Remember no contract, no claim.
