View Full Version : Answer to the Complaint (Maryland, Prince George's Circuit Ct)

Hello all! I've been reading and reading, but haven't seen my particular situation addressed.

I have been summoned for repayment of a $55802.00, unsecured loan. I responded, not able to find an Answer to the Complaint form, doing the best I could. This is not my question, but here is some background.

The thing is, I owe this but will never, ever be able to pay. My husband left me with $643,900.00 in debt in MY name. Yes, those zeros are correct. I realize a judgement will be made against my house (in my name), but as I let them know, I have three secured (1st mortgage, 2 home equity, 3 repayment agreement) ahead of them in the line of those who could collect.

My husband does not work, and I teach yoga. Everything in the world goes to keeping my home. My husband has signed an agreement to assume 1/2 of the above debt. As per legal advice, it's delineated, notarized, and published in the classifieds. This $55k loan being one of them.

I've received a memo stating my Answer is not accepted because it's not complete. I must answer 2-323a, nor serve my complaint. (I mailed it and am resending it today, I hope).

I want to tell them I owe, or my husband now owes, and it wouldn't be in their best interest, time-wise, to try to get this money from me. So...
Anyone got a sample Answer to the Complaint that would fit this situation?
And any suggestions would be fantastic. However, keep in mind that bankruptcy is NOT an option.

To add fuel to the fire, I just got a collection notice from a different law firm! What the heck?
