View Full Version : Terminated under false pretences in TX by Health Care Service Corporation.

Over a year ago while out on medical leave I received a certified letter in the mail form my now former supervisor that I was terminated a month prior to the letter being sent to me.

They refused to tell me why I was terminated and I only found out through the Texas Workforce Commission. It was all made up because I was one of the few employees that did not misuse the company email. Violators run a muck in the company.

Anyway, I had been in contact via email with the manager of my department and advised him I would still be out on medical leave because the doctor would not release me. It wasn't until a month after they fired me that the doctors found out that I had Chron's disease.

There are hundreds of people whom this health insurance company has fired due to being out of medical leave. Even if you don't run out. Which I do believe I had run out of my FMLA. That is why I contacted the manager and he told me not to worry. That I would be just fine and to just get better.

Never the less the stupid supervisor fired me and they up held it. What I want to know is even though Texas is a "Right to Work" state, is there anyone I can contact whom would form an investigation of this company and their practices?

It should be illegal to fire someone for being sick. Oh.. for any of you whom feel I should have tried to file for disability. I had the insurance I paid for for through this company for over SEVEN YEARS and since I had not worked and could not pay the premiums and they waited to notify me a month AFTER they had fired me... well... my time limit was gone. I want them to be held accountable not just to me but to all the other former employees they screwed. Any suggestions?

If your federal leave time and company leave time ran out, they are fully within their rights to let you go.

Okay. Thank you. Darn it. I guess I could toilet paper that darn supervisors house right.. lol

FMLA, represents the reasonable time a company must allow for individuals who are sick or fall under the FMLA umbrella. 12 weeks is a reasonable time frame and if your illness exceeded that, it is sad, but ultimately not the company's responsibility to shoulder the cost of.

I am sorry, but you are out of luck on that one.
