I have full custody of my child, and I want to move to a different state with my fiancé but my ex tells me I can't move out of the state? He also has a history of physically and mentally abusing me, and currently have a restraining order on him. He's trying to get joint custody so he doesn't have to pay the child support (which has never paid). I also don't have family in either state

If he abused you then why are you taking orders from him if you move to that state he won't know exactly where you live. Change your name and you can always visit your parents

Does the father have any visitation rights? If so it would be illegal for you to move without court permission. If he has no visitation rights then the courts should give you permission. Either way, to be on the safe side you NEED to get the court's permission to move.

If there is pending court procedures, then you can't move until they are resolved. And if you try to hide from him, you could be found guilty of parental kidnapping.

From the info you have provided I would think you probably wouldn't have trouble getting court permission to move. But I would not risk doing so without court permission.

Mod note: This was moved from the Children forum because it's a legal question.

Agreed with Scott, he has rights to visit with the kids, even if it is supervised, and I assume he has a child visitation order.

You will have to go though the court and get permission to move.
