I would like a total distribution of my 401k. I am still employed and under the age of 59 1/2.

Merrill Lynch is trying to tell me I am not eligible, therefore refusing to give me my own money.

I understand the 10% penalty, fine.

Reasons I seek to cash out are not relevant. I just want my money and ML out of my life.

Transfer your money to a discount broker. This will save you fees on liquidation. If they refuse, send a registered letter to your broker, or the pool of brokers, and copy your attorney. Give them 2 business days to comply with your request. If they do not comply, have your attorney file a claim. Stock Brokers FORCE you in to mediation before you do business with them. Your case will be heard by a panel of brokers and "lay people". Request the mediators that ML pay all legal fees. Never make any written or verbal threats. Stick with the process. Good Luck.
