ANY question on law needs to include your general locale as laws vary by area. So you have really not given us enough to provide an answer. Some of the things that would help us answer you are:
a) where the rental is located
b) is there a current lease or is the tenant month to month
c) why is the tenant being asked to vacate, is it due to non payment of rent or some other reason
