View Full Version : If violated on Felony Probation with a DUI... Help.

Can my probation officer give me a court date for the Violation Hearing or do I HAVE to be arrested?

Felony Probation for Burglary. I can drink under the terms of my probation. I left the club and sat in the drivers seat with the keys in the center console while I tried to call friends to come get me, and a cop stopped by and arrested me for Misdemeanor DUI.

My probation officer likes me. This is my first time on probation. Any help would be appreciated.

Also, my attorney wants me to pay off the rest of my fines and then ALL my probation conditions will be completed. He wants to go for a Early Termination this week before I have my monthly PO visit on Friday. I've only been on probation for 9 months and it was 3 years total, you think the Judge would be able to terminate me that early since I have everything done?

They can schedule a violation hearing WITHOUT arresting you. I don't know why you're talking about an early termination... You just VIOLATED your probation... They AIN'T letting you go early...

And if you have not already called and told your PO, you are in a much more serious for not notifing the PO ASAP. So if you are thinking about not telling him, or trying to get it dropped, without then knowing, forget it, they will run a NCIC on you before they would release probaton.

Also no, with 3 years, after 2 and nothing wrong, they might, but not with the little time you have done. And of course, with a new violation, so close, they will not drop probatoin early now.

Yes the PO can merely give you a date to appear ( but they seldom do)
