I divorced in April of this year, we had joint custody. September 6 of this year I had to enter a shelter for abused and battered women with my 3 youngest, 9,5,3. I moved out of the shelter got an apartment and entrollred the kids in school. I went back home for a visit with my oldest son and 7 days later I went back home. 2 days after I went home my ex showed up at my door to serve me with custody papers saying that I was in contempt of court for moving the kids. He got a judge that his family knows personally to sign this order and to put a protection order against me. The judge is very close to this case and he ruled anyway. I go to court Dec 2 in front o fthe same judge. I have an attorney but would still like some advise.
Can my ex serve me himself? Can thid judge who knows his violent violent history legally give my kids to him? Do I have a prayer?

First off not knowing where you are can make a huge difference in the answer your going to receive. Courts have different rules depending on where this is taking place.

Your lawyer should file papers for changing judges if what your saying is true and can be proven.
