Hi, I found an apartment for November first. The landlord told me that he would have everything fixed by the time I moved in so I gave him first month's rent in mid October. The landlord had not fixed the problems in the apartment so I didn't want the apartment anymore. He told me that I would get my money back when he find a new tenant for the apartment. I didn't receive any money when the first of November came around and he had found a tenant. I have been in contact with him several times and he says he doesn't have the money and he'll call me when he does. It has been a month and still nothing. Any advise?

Sure. Sue him in small claims court. When you win, you can just TAKE your money out of his bank account.
